Child Custody Lawyer in Woodland Hills

Child Custody & Support in Los Angeles & Ventura County

There are numerous aspects of divorce that make the process tough to handle. In addition to fairly dividing assets, many divorcing couples must agree on who gets custody of the children. Determining child custody involves many logistical and emotional challenges that are best addressed with the help of a family law attorney. If you and your spouse are getting divorced in Los Angeles and Ventura County, consider scheduling an appointment with the Law Offices of Allan P. Loewe. Both Allan Loewe and Annette Kulik have decades of experience handling family law issues.

Types of Child Custody

Before you and your spouse can agree on custody, it's important that you become familiar with the different possible arrangements. After several meetings with your lawyers and a judge, you should come up with an arrangement that everyone can live with.

  • Physical Custody: Physical custody refers to which parent the child lives with. Physical custody may be determined by a number of factors, including the parents' incomes, their lifestyles, and which parent lives in the childhood home.
  • Legal Custody: A parent with sole legal custody is solely responsible for making important life decisions for the child. This may include decisions related to healthcare, religion, and education.
  • Sole and Joint Custody: Both physical and legal custody can be shared between the two parents. Parents who agree on joint physical custody split time with their children more or less 50/50.

Determining Child Support:

If one parent is awarded sole physical custody, the non-custodial parent will likely be ordered to pay child support. Child support is meant to help cover all the expenses associated with raising a child.

  • Parental Income: Each parent's income is taken into consideration when determining a fair child support amount. The parent responsible for paying child support must have enough left over to cover his or her own expenses.
  • Childcare Expenses: The amount paid in child support should be directly related to the child's needs. A child with a disability or chronic condition may require a substantial monthly sum.
  • Pre-Divorce Lifestyle: It's important for children to be as comfortable as possible after divorce. The amount paid in child support should make it possible for a child to maintain his or her pre-divorce lifestyle.
