Business & Commercial Litigation

Business disputes are often the unavoidable consequence of business pursuits. They can be expensive, distracting, and emotionally difficult. If unresolved, they can quickly escalate into business or commercial litigation. Whether you need a consultation to understand your rights and options, or whether you need to retain counsel because you are being sued or are contemplating filing suit, you should seek the reassuring guidance of an experienced attorney.

At the Law Offices of Allan P. Loewe, we have considerable experience handling a wide range of business and commercial litigation, including trials, appeals, arbitration, and mediation, in both State and Federal Court.

We prosecute and defend cases involving:

  • Breach of Contract
  • Business Torts
  • Disputes arising out of Partnership Formation and Dissolution
  • Fraud and Misrepresentation
  • Breach of Fiduciary Duty
  • Libel and Slander [Defamation]
  • Injunctions and Restraining Orders
  • Enforcement of Judgments
  • Writs of Possession
  • Lien Foreclosure
  • Unfair Business Practices
  • Trade Secrets
  • Non-Competition Clauses
  • Interference with Contractual Relations
  • Interference with Prospective Business Advantage
  • Partnership Disputes
  • Other Business Disputes

Commercial Litigation

Our business clients also retain us to pursue commercial accounts resulting from the sale of goods and services, based on open accounts, account stated, invoices, promissory notes, breach of contract, and certain equitable remedies, such as restraining orders and writs of possession, and enforcement of judgments. If you have obtained judgment against a creditor in another state, we can domesticate and enforce your judgment in the State of California as well.

Representation Tailored To Your Needs

At the Law Offices of Allan P. Loewe, we pride ourselves on being aggressive and vigorous in both the prosecution and defense of business cases, and yet we recognize that it may be in a client's best interest to defuse a dispute so it can be beneficially resolved. It is vital that your attorney appreciates that the bottom-line of litigating business disputes is not necessarily to win at all costs, but to always act in a manner that is consistent with smart business. That may mean compromising in some situations, or it may mean forcefully pursuing a case through trial and appeal. You should hire an attorney who does not take the same approach to every lawsuit, but instead tailors the handling of your case to fit your particular needs and finances.

Attorney ' s Fees and Costs

Fee arrangements are designed and tailored to fit the needs of each client. There are basically three fee arrangements. Each fee arrangement may not be suitable for every case:

1. Hourly Fee: Our clients are billed for the actual time that attorneys and paralegals spend on their case. Hourly rates are set and agreed upon before any fees are charged;

2. Contingency Fee: Our clients pay us an agreed-upon percentage of the money that we actually collect for

them. If no money is recovered, no fee is charged;

3. Hybrid Fee: There are numerous types of hybrid fees. They may involve a combination of an hourly and contingency fee, or a fixed retainer against a contingency fee. Hybrid fees can give our clients the flexibility to tailor their fee arrangement to their particular needs;

Costs: Our clients are responsible for court costs, although we may advance costs in certain situations;

Free Initial Consultation: In many cases, we offer a free one-hour initial consultation.
